dc.description.abstractSavunma ve korunma insanın doğasında olan bir duygu ve dürtüdür. Tarih boyunca da bu ihtiyaç nedeniyle kabile, aşiret, klan şeklindeki toplumsal gruplar halinde yaşarken de aynı ihtiyacı duyan insanoğlu, günümüzde devlet denilen en gelişmiş ve modern sosyal teşkilat içinde de bu ihtiyacı duymaya devam etmektedir. Milli savunma ihtiyacı, devletlerin de duyduğu bir ihtiyaç olup, ceza kanunlarında bu ihtiyacı korumak için askeri hizmetten kaçma teşkil eden fiillerin, ordusu olan her ülkede suç sayılarak cezalandırıldığı görülmektedir. Bu çalışmada, askeri hizmetten kaçma fiillerinin Asya ve Ortadoğu’nun bazı ülkelerinde nasıl düzenlendiği üzerinde durulmaya çalışılmıştır. Mukayeseli hukuk çalışması olarak faydalı olması için gayret gösterilen çalışmada sadece firar suçu değil, askeri hizmetten kaçma teşkil eden diğer bazı fiillere de nispeten yer verilmiştir
dc.description.abstractDefence and protection are the motive and the feeling that exist in human nature. Because of this necessity of defence and protection, human being has been living in social communities such as tribe and clan. In the same way, they still feel the same necessity while living in a government that is the most developed and modern social organisation. The need for national defence is also a necessity for governments, so in order to meet this necessity, the actions that violate the compulsory military service are regarded as crimes and punished according to the crimal laws of governments having an army. How the actions considered as draft evasion are regulated in some Asian and Middle Eastern countries is the main subject of this study. In this study, which is intented to be useful as a comparative law study, not only desertion but also some other actions regarded as evading military service are relatively examined
