dc.description.abstractBu çalışmada, milletlerarası ticarette yaygın olarak kullanılan INCOTERMS 2020 teslim şekillerinin, Türk Ticaret Kanunu’nda düzenlenen navlun sözleşmelerinin ifasına ve taraflar arasındaki hukuki sorumluluk ilişkisine etkisi incelenmektedir. Bu kapsamda tezde, öncelikle navlun sözleşmesinin hukuki niteliği, unsurları ve tarafları ele alınmış; devamında INCOTERMS kurallarının tarihsel gelişimi, hukukî niteliği ve uygulama alanı değerlendirilmiştir. Çalışmanın son bölümünde ise FAS, FOB, CFR ve CIF teslim şekilleri özelinde yükleme, teslim, hasarın geçişi, navlunun ödenmesi, sigorta yükümlülüğü ve taşıma belgelerinin düzenlenmesine ilişkin yükümlülüklerin navlun sözleşmesine etkileri karşılaştırmalı olarak analiz edilmiştir.
dc.description.abstractThis study examines the impact of the INCOTERMS 2020 delivery terms, which are widely used in international trade, on the performance of freight contracts regulated under the Turkish Commercial Code and on the legal liability relationship between the parties. In this context, the thesis first examines the legal nature, elements, and parties of the freight contract; then, the historical development, legal nature, and scope of application of INCOTERMS rules are evaluated. In the final part of the study, the obligations related to loading, delivery, transfer of risk, payment of freight, insurance liability, and the issuance of transport documents under the FAS, FOB, CFR, and CIF delivery terms are analyzed comparatively for their impact on the freight contract.
