| dc.description.abstract | Uygulamada, "maketten satış" veya "sat-yap" olarak adlandırılan ve henüz ortada bir konut olmadan tüketicinin para ödemeye başlaması ve bu konutların satışının yaygınlaşması, buna bağlı olarak çeşitli sorunların ortaya çıkmasına sebep olmuştur. Sözleşmenin yazılı şekilde yapılması, henüz konutun inşa edilmemiş veya inşasına başlanmamış olması ve tüketicinin konutun bedelini ödemeye başlaması, bu alanda özel bir düzenleme yapılmasını zorunlu kılmıştır. Bundan dolayı 6502 sayılı Tüketicinin Korunması Hakkında Kanun m. 40-46 hükümleri arasında ön ödemeli konut satışı sözleşmesi ayrıntılı olarak düzenlenmiştir. Bu çalışmada ön ödemeli konut satışı sözleşmesini tanımlayarak, ön ödemeli konut satışı sözleşmesinin yapılabilmesi için gerekli koşullar, sözleşmenin şekli, tüketiciye tanınan cayma ve dönme hakkı ile bunların sonuçları, konutun teslim edilmemesine bağlı olarak tüketicinin sahip olduğu haklar açıklanacaktır. | en_US |
