| dc.description.abstract | Çalışmanın konusunu oluşturan karşılıklı borç yükleyen sözleşmelerde borçlunun temerrüdünün sonuçları, 6098 sayılı TBK'nın 123-126 maddeleri arasında düzenlenmiştir. Bu hükümler incelendiğinde, borçlunun, borca aykırı olarak, asli edim yükümlülüğünü zamanında ifa etmeyip temerrüde düşmesi halinde alacaklıya, temerrüdün genel sonuçları haricinde bir de seçimlik haklar tanınmış olduğu görülecektir. Çalışma iki bölümden oluşmaktadır. Birinci bölümde karşılıklı borç yükleyen sözleşmelerde borçlunun temerrüdü ile temerrüdün hangi şartlarda oluştuğu anlatılmıştır. İkinci bölümde ise, borçlunun temerrüdünden sonra ortaya çıkan alacaklının seçimlik hakları ile karşılıklı borç yükleyen sözleşmelerde temerrüdün diğer sonuçları üzerinde durulacaktır. Bu çalışmada karşılıklı borç yükleyen sözleşmelerden kastımız ve incelenecek olan sözleşme tipi tam iki tarafa borç yükleyen sözleşmeler olacaktır. | en_US |
| dc.description.abstract | The results of the default of the debtor in contracts that load mutual debt, which are the subject of the study, are regulated between the articles 123-126 of the Turkish Code of Obligations. When this provisions are examined, it will be seen that if the debtor does not perform his essential performance obligation in timely manner, the creditor shall be granted elective rights ecxept the general results of the default. The study consists of the two parts. In the first chapter, the default conditions of debtor in terms are explained. In the second section, the elective rights of creditors arising from the default of the debtor and the other consequences of the default will be emphasized.
