dc.description.abstract27 Aralık 2008-18 Ocak 2009 tarihleri arasında İsrail’in Gazze Şeridi’ne yönelik saldırısı, bir insanlık trajedisi ortaya çıkarmıştır. Çatışmanın bir tarafında Gazze’yi 2007 yılından beri kontrol altında tutan Hamas, diğer tarafında ise İsrail yer almıştır. Hamas-İsrail çatışmasında tarafların kendi konumlarını uluslararası ilişkilerdeki bir kısım kavramlarla haklılaştırma yoluna gittiği gözlenmiştir. İsrail’in nefs-i mudafaa hakkı çerçevesinde hareket ettiği, Hamas’ın da İsrail işgaline karşı direniş sergilediği ifade edilmiştir. Tarafların bu girişiminin en önemli nedenlerinden biri, çatışma öncesinde, sırasında ve sonrasında ortaya çıkan trajedinin sorumluluğunu üstlenmek istememeleridir. Bu amaç, tarafların içinde bulundukları konumun bir gereğidir. Diğer yandan, taraflarca kullanılan bazı kavramların genel olarak uluslararası ilişkilerde özelde ise uluslararası hukukta ne anlama geldiğinin açıklığa kavuşturulması, İsrail ve Hamas’ın Gazze krizinde sahip olduğu sorumluluk paylarının belirlenmesine yardımcı olabilecektir. Bu çerçevede çalışmada, devlet, savaş, işgal, terör, direniş, nefs-i mudafaa, temsil ve uluslararası yükümlülükler gibi kavramlar Gazze bağlamında yorumlanmış ve meydana gelen krizin sorumluluğunun daha çok İsrail tarafında olduğu iddia edilmiştir
dc.description.abstractIsraeli assault on Gaza between December 27, 2008 and January 18, 2009 has created a humanitarian tragedy. On the one side of the conflict Hamas took place which has been controlling Gaza since 2007, the other side was Israel. It has been observed that the parties in Hamas-Israel clash tended to justify their position by using some concepts of international relations. It has been commonly stated that Israel acted as a requirement of self-defence and Hamas demonstrated resistance against Israeli occupation. One of the most important reason for this act of the parties was that they did not want to undertake the responsibility of the tragedy before, during and after the confrontation. This goal is a necessity of their position in the context. Nevertheless, clarification of these concepts used by the parties in international relations in general and in international law in particular could help to determine the share of the responsibilities of Israel and Hamas in Gaza crisis. Within this framework in this essay, some concepts like state, war, occupation, terror, resitance, self-defense, delegation and international obligations are assessed in the context of Gaza and it is claimed that Israel is more responsible for the recent crisis
