| dc.description.abstract | Bu çalışma uluslararası alanda küreselleşme vasıtasıyla hızla şekil değiştiren, devletler arası mücadelede asimetrik bir güç haline gelen terör ve terörizm kavramının, hukuki bir perspektiften ele alınıp irdelenmesiyle birlikte tespit ve çözüm ortaya koymaya çalışmıştır. Tezin amacı terör tarihi açısından hukuki bir çerçevede tanımlama yapılamamasının nedenleri ile birlikte, ortaya bir tanım konması nihayetinde çerçeve bir kararla yaptırımların ortak bir platformda hukuka uygun şekilde oluşturulması konusunu irdelemektir. Çalışmanın ilk bölümünde terörün, insanlık tarihi kadar eski oluşu, yılların değişkenliği ve nihayetinde evrim geçirmesi ile dünya genelinde şiddetini her dönem giderek artması sonucunda ortaya çıkan sorunlara değinilecek akabinde terör konusunun başında gelen tanım sorununa hukuki ve doktrinsel açıdan irdelenmeye başlanacaktır. Ardından terör ve terörizmin hangi amaç doğrultusunda yapıldığı sorusuna cevap aranırken uluslararası arenada terörizmin değişimi ile yeni terörizm olgusu ele alınacaktır. İkinci bölümde terör olaylarının yayılmasını hızlandıran ilk etmen olan küreselleşme olgusunun doktrinsel olarak ele alınacak ve tarihi gelişimi açısından incelenecektir. Küreselleşmenin çevre ülkeler açısından gelişmelerine yardımcı olan bir kavram mı olduğu yoksa üzerilerinde baskı kuran hegemonik bir kavrama mı dönüştüğü konusu ile bu süreç sonucunda kurulan düzenin küresel terörizme nasıl yol açtığı ve bunu hangi etmenlerle başardığı konusu incelenecektir. Üçüncü bölümde terörle mücadele konusunda uluslararası alanda hukuki incelemeler yapılarak bu bağlamda hukukun yetersiz kaldığı yerler tespit edilip küresel terörle mücadele de hukuki işbirliğinin önemi konusu vurgulanacaktır. | en_US |
| dc.description.abstract | This study tries to present assessments and solutions of the terms 'terror' and 'terrorism', which change fast via globalization and became an asymmetric power in the interstate struggle, by scrutinizing ina legal perspective. The aim of the study is to scrutinize the imposing sanctions lawfully in a common platform according to a framework decisionafter setting a definitionwith the reasons why the terrorism could not be defined in a legal perspective in the context of the history of terror. In the first chapter of the study,terror's being as old as the history of humankind, the problems emerged as a result of its universality evolving in years, scrutinizing the problem of definition, which is the leading problem, in a legal and doctrinal way will be began. Afterwards, the diversity of the topic will be examined with regards to the reasons of the terrorism. While looking for answers to the question for what reasons the terror is committed, the new perception of terrorism after its mutation in the international arena is discussed. In the second chapter,the topic of the how agedness is the globalization, which is the primary factor in expanding the terror events, will be taken in a doctrinal approach. Whether the globalization serves for development for the other countries or hegemony over them, how the hegemony set after this process causes global terrorism and what instruments it accomplishes this will be examined. In the third chapter, the legal cooperation in the fight against terrorism will be emphasized by making legal examination in the international fight against terrorism and the points where the international law fails. | en_US |
