Gemi, açık denizde iken kaptanın yetkileri oldukça geniştir. Bu sebepten ötürü kaptanlığın hukuki statüsü de tartışma konusu olmuştur. Bu çalışmada; deniz iş hukuku okuyucuya tanıtılmaya çalışılacak, deniz iş sözleşmesinin tarafları ve borçları izah edildikten sonra kaptanın tanımı ve hukuki statüsü tartışılacak, kılavuz kaptanların durumu ortaya konmaya çalışılacak ve son olarak kaptanın görev ve yükümlülükleri izah edilmeye çalışılacaktır. According to the Maritime Labor Code, one of the most authorized persons in the management and administration of the vessel is the shipmaster. The shipmasters authorities are quite extensive when the ship is in the off-shore. For this reason, the legal status of the shipmaster has also been a matter of debate. In this study; maritime labor law will be introduced to the reader, after explaining the parties and obligations of the maritime labor contract, the definition and legal status of the shipmaster will be discussed, the position of the maritime pilots will be revealed and finally the shipmaster's duty and obligations will be explained.
