Özet
Soykırım Sözleşmesi'ne göre, soykırım suçu; millî, etnik, ırkî veya dinî bir grubun, sırf bu niteligi nedeniyle, Soykırım Sözlesmesi'nde sayılan fiillerin yok etme özel kastıyla gerçekleştirilerek kısmen veya tamamen yok edilmesidir. Soykırım suçunun oluşumunda hedef grubun tespiti ve özel kastın ispatı çok büyük öneme sahiptir. Ruanda ve Eski Yugoslavya Uluslararası Ceza Mahkemeleri de Soykırım Sözleşmesi'ni yorumlamıslar ve uygulamaya geçirmislerdir. Soykırım suçu faillerinin yargılanmasında güçlüklerle karsılasılmaktadır. Uluslararası Ceza Mahkemesi'nin kurulması uluslararası toplum için yeni bir umut olmuştur. Uluslararası ceza hukukunu ilgilendiren soykırım suçu Türk Ceza Kanunu'nda da düzenlenmis ve Türkiye Cumhuriyeti bu suçun önlenmesi yönündeki kararlılığını göstermiştir.
According to the Genocide Convention, the crime of genocide means any of the following acts, described in article II of the Convention, committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such. The victimised group concept and the dolus specialis has great significance in proving the genocide. Article II of the Genocide Convention is interpreted in the jurisprudence of the International Criminal Tribunals for Former Yugoslavia and Rwanda. By the trials of ad hoc Tribunals the definition of genocide is being applied in practice. With regard to genocide, there are many remarkable difficulties in the trials of the perpetrators. On the other hand, setting International Criminal Court, international community has been encoured to prevent that crime. One of the subjects of the international criminal law, genocide is set and put into practice by Turkish Penal Code, by that Turkey has proved its determinence of preventing of genocide.
