Özet
Tez konusu çalışmada, şiddete maruz kalan sağlık çalışanlarının ceza hukuku, tazminat hukuku ve idare hukuku alanlarında yararlanabilecekleri yasal korunma yolları ile devletin, şiddet nedeniyle maddi ve/veya manevi zarara uğrayan sağlık çalışanlarının zararlarını tazmin etme yükümlülüğü incelenmiştir. Üç ana bölümden oluşan tezin birinci bölümünde, şiddetin tanımı yapılarak, nedenleri, türleri, döngüsü ve şiddetin sağlık çalışanları ile hasta ve hasta yakınları üzerindeki etkileri incelenmiştir. İkinci bölümde, sağlık, hastalık ve hasta kavramları açıklanarak, sağlık çalışanlarının hakları ile hasta ve hasta yakınlarının yükümlülükleri anlatılmıştır. Tezin üçüncü bölümünde, sağlık çalışanlarına karşı işlenebilen şiddet suçları incelenmiş, şiddetin önlenmesine yönelik yasal ve idari düzenlemeler açıklanmış, sağlık çalışanlarının şiddet nedeniyle uğradıkları maddi ve/veya manevi zararların tazmini amacıyla yararlanabilecekleri yasal yollar ile devletin gerek şiddetin önlenmesi gerekse şiddete uğrayan sağlık çalışanlarına karşı tazmin sorumluluğu ele alınmıştır.
In this thesis study, the following issues have been examined: the legal remedies, which can be benefited by the healthcare professionals, who have been subjected to violence, in the areas of criminal law, compensation law and administrative law and state's liability to compensate healthcare professionals who suffered material and/or moral damage due to such violence. In the first part of the thesis, which consists of three main parts, by making a definition of violence, its causes, types, cycle and the effects of violence on healthcare professionals, patients and relatives of the patients have been examined. In the second part of the thesis, the concepts of health, illness and patient are explained and the rights of healthcare professionals and the obligations of patients and relatives of the patients have been explained. In the third part of the thesis, violent crimes that can be committed against health professionals have been examined, legal and administrative regulations for the prevention of violence have been explained, the legal remedies, which can be benefited by the healthcare professionals, for the compensation of material and / or moral damages they have suffered due to violence and the state's liability for both prevention of violence and compensation for healthcare professionals who have been subjected to violence have been discussed.
