Özet
Bu çalışma, gümrük uyuşmazlıklarının idari süreçte çözüm yolu olan uzlaşma müessesesini tanıtmakta ve çalışma yöntemini ele almaktadır. Öte yandan çalışmada uyuşmazlıkların idari süreçte ve yargısal süreçte çözümüne de değinilmektedir. Birinci kısımda genel olarak gümrük mevzuatına değinilerek, gümrük uyuşmazlığına giden süreç ele alınmakta, çözüm süreçlerine değinilmektedir. İkinci kısımda gümrük uyuşmazlıklarının idari süreçte çözüm yolu olan uzlaşma müessesesinin tanımı yapılarak çalışma yöntemleri ve sonuçları ele alınmaktadır.Bu çalışma uzlaşma müessesesinin etkin çalıştırılarak uyuşmazlıkların yargı yoluna taşınmadan daha hızlı ve kesin bir şekilde sonuçlandırılmakta olduğunu ortaya koymaktadır.
This study introduces the settlement procedure, which is a way of solution to the customs disputes during the administrative process, and covers the implementation methods thereof. On the otherhand, the settlement of disputes during administrative and judiciary processes are mentioned in the study. Making mention of the customs legislation in general, the first chapter adresses to the process leading to the customs disputes and makes mention of settlemen tprocesses. The second chapter defines the settlement procedure, which is a way of solution to the customs disputes during the administrative process, and adresses to the implementation methods and results thereof. This study demonstrates that the disputes are settled in a faster and more conclusive way without having recourse to legal remedies by effectively implementing the settlement procedure.
