Özet
Bu çalışmanın amacı; ülkemiz hukuk sistemi açısından son derece yeni sayılabilecek Anayasa Mahkemesine bireysel başvuru kurumunun detaylı bir analizinin yapılmasıdır. Bu analiz yapılırken temelden başlanarak kurumun hukuki altyapısı ile ilişkili olduğu alanlar irdelenmiş, mevzuat hükümleri temelinde de oluşumunun ve işleyişinin detayları ortaya konulmuştur. Bireysel başvuru hakkını kullanmayı amaçlayan bireyin, en başından izlemesi gereken yol ile bu başvurunun Anayasa Mahkemesi nezdinde izleyeceği seyir, hakkın kullanılması sonucunda ortaya çıkabilecek çeşitli durumlar ve sonuçlar açıklanmıştır. Ayrıca çalışmada kurumun teknik oluşum ve işleyişinin yanında; temelinde taşıdığı amaç, kurum aracılığıyla tesis edilmek istenen toplumsal güven duygusu ile yapı olarak kurumun düzenlenişinin bu amacı gerçekleştirmeye elverişliliği de değerlendirilmeye çalışılmıştır.
The purpose of the study is analysing in detail of the individual application to the Constitutional Court which can be considered extremely new according to the judicial system of our country. While making this analysis, the areas which are related to the legal infrastructure have been studied beginning from the foundation, also at the foundation of the legislation provisions, the details of the formation and the functioning of it have been demonstrated. The way a person who intends to use the right of individual application has to follow and the course this application follows at the Constitutional Court, the stuations and results that can arise after the use of right have been explained. Also in this study, beside the technical foundation and functioning of the institution; the purpose it carries in the basis, the social confidence which has been intended to be established and the availability of the institution to fulfil this purpose are tried to be evaluated.
