Özet
Evlilik, karşı cins iki kişinin kendi iradeleriyle kurdukları bir birlikteliktir. Bu
birliktelik, evlilik birliği olarak adlandırılır ve eşlerin birbirlerine karşı sorumlu
oldukları yükümlülüklerini yerine getirmeleri ile devam eder. Ancak eşler bazı
durumlarda bu birliği sonlandırılabilmektedir. Tezimizin konusunu da “Evlilik
Birliğinin Türk Medeni Kanunu’nun 162. Maddesi’ne Göre Sona Ermesi”
oluşturmaktadır.
Tezimiz üç ana bölümden oluşmaktadır. Birinci bölümde, TMK m. 162
hükmüne dayalı boşanma sebepleri ve sonuçlarının daha iyi anlaşılabilmesi açısından;
evlilik birliği ve evlilik birliğinin sona erme halleri tanımlanacaktır. Akabinde ise
boşanma ve TMK’de düzenlenmiş olan boşanma sebepleri ele alınacaktır.
Tezimizin ikinci bölümünde ise TMK m. 162 hükmü kapsamında boşanma
sebepleri olan hayata kast, pek kötü ve onur kırıcı davranış sırasıyla tanımlanacak olup
daha sonra bu nedenlere dayalı olarak açılabilecek boşanma konusu Yargıtay kararları
ışığında işlenecektir.
Üçüncü bölüm olan son bölümde ise TMK m. 162 hükmüne dayanılarak açılan
boşanma davalarının sonuçları ele alınacaktır. Bu sonuçların neler olduğu ve nasıl
meydana geldikleri üzerinde durulacaktır.
Marriage is a union established by two opposite sex people at their own will. This union is called the marital union and continues with the fulfillment of the obligations that the spouses are responsible to each other. However, in some cases, this union can be terminated by the spouses. The subject of our thesis is "The Termination of Marital Union According to Article 162 of Turkish Civil Code". Our thesis consists of three main sections. In the first part, in order to better understanding of the causes and consequences of divorce based on article 162 of Turkish Civil Code; marital union and the termination of marital union will be defined. Subsequently, divorce and grounds for divorce regulated in Turkish Civil Code will be discussed. In the second part of our thesis, attempt against life, very bad and defamatory behavior will be defined respectively, which are the reasons for divorce within the scope of article 162 of Turkish Civil Code, afterwards the divorce cases which may open based on these reasons, will be discussed in the light of the Supreme Court's decisions. In the last section, which is the third one, the results of divorce cases filed on the basis of article 162 of Turkish Civil Code will be discussed. We will focus on what these results are and how they take place
