Özet
Çalışma konumuzu "Arsa payı karşılığı inşaat sözleşmesinden dönme ve arsa payı karşılığı inşaat sözleşmesinin feshi" konuları oluşturmaktadır. Arsa payı karşılığı inşaat sözleşmesinden dönme ve arsa payı karşılığı inşaat sözleşmesinin feshi kanunda açıkça ve ayrıca düzenlenmemiştir. Çalışmamız üç ana bölümden oluşmaktadır. Birinci bölümde; arsa payı karşılığı inşaat sözleşmesinin tanımı ve unsurları, sözleşmenin hukuki niteliği ile sözleşmenin meydana getirilme biçimleri incelenmektedir. Çalışmamızın ikinci bölümünde; tarafların borçları izah edilmiş, yüklenicinin temerrüde düşmesi halinde arsa sahibinin hakları ve bu hakları kullanmanın koşullarına kapsamlı olarak değinilmiştir. Çalışmamızın son bölümünde; fesih ve dönme kavramı arasındaki farklar, konuya ilişkin doktrindeki tartışmalar, dönmenin sözleşmeye etkisi üzerine teoriler, arsa payı karşılığı inşaat sözleşmesinden dönme, tarafların sözleşmeden dönme ve sözleşmeyi fesih halleri incelenmiştir. Ayrıca bu bölümde; sözleşmeden dönme hususunda, Yargıtay uygulaması ve sözleşmeden dönmede Yargıtay'ın ifadesi ile "kat karşılığı inşaat sözleşmesinin feshinin geçmişe etkili olması" halinde yüklenici tarafından üçüncü kişilere satılan bağımsız bölümlerin iadesinde yaşanan mağduriyet belirtilmiştir.
The subject of our study is "Recocation of the construction contract in return for land share and rescission of the contract". In the first part; The definition and elements of the construction contract in return for flat, the legal nature of the contract and the forms of the contract are examined. In the second part of our study; The debts of the parties have been explained, the rights of the landlord in case of default of the contractor and the conditions of exercising these rights have been comprehensively mentioned. In the last part of our study; The differences between the concept of termination and return, the debates in the doctrine, the theories on the effect of rotation on the contract, the recocation from the construction construction contract in return for land share, the rescission of the contract and the rescission of the contract are examined. In addition, in this section, the practice of the Court of Cassation in terms of rescinding the contract and the expression of the Court of Cassation in rescinding the contract's, problems in the return of the independent sections sold by the contractor to 3rd parties in case of "the termination of the construction contract in return for flat has a retroactive effect" is stated.
